The rules for using Brimful: what the app does, what it is not, and how the subscription works.

Agreement to these terms
By creating an account or using Brimful you accept these terms. If you do not accept them, please do not use the app.
Who we are
Brimful is developed and operated by Berny Studio. You can reach us at brimful@bernystudio.com.
What Brimful is
Brimful is a personal tracking tool for drinks, liquid calories, alcohol, sugar and caffeine. You log what you drink, and the app shows totals, goals and history.
The drink database is provided for convenience. Nutritional values come from public sources and from what users enter, and may be incomplete or out of date: always check the label if a value matters to you.
Not medical advice
Brimful is a wellness tool, not a medical device. The figures it shows, including any blood alcohol estimate, are indicative, calculated with generic formulas, and depend on data you enter yourself.
They are not a diagnosis, they do not replace professional advice, and they must never be used to decide whether it is safe to drive. If you have been drinking, do not drive. If you have a health concern, talk to a doctor.
Eligibility
You must be at least 16 years old to create an account. By using Brimful you confirm that you are, and that no law prevents you from using the service.
Your account
You are responsible for keeping your credentials safe and for everything that happens under your account. Give us accurate information when you sign up, and keep it up to date, because the app's estimates depend on it.
Tell us straight away if you think someone else has accessed your account.
Your data stays yours
The entries and custom drinks you create belong to you. We store and process them only to provide the service to you, as described in the Privacy policy.
You can export your entries as a CSV file, and delete your account and all its data, from the app's settings at any time.
Acceptable use
When using Brimful you agree not to:
- use the app for unlawful purposes, or in breach of these terms;
- try to access other users' data, or any part of our systems you are not authorised to reach;
- reverse engineer, decompile or tamper with the app, except to the extent the law allows;
- scrape, copy or resell the drink database, or access the service through automated means;
- upload content that is unlawful or infringes someone else's rights.
Brimful Plus
Brimful Plus is an auto-renewing in-app subscription, monthly or yearly, sold through the App Store. New subscribers get a 7-day free trial.
The subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends, from your Apple account settings. Payment is charged to your Apple account when you confirm the purchase. You can manage or cancel the subscription at any time in your device settings.
If we change the price, you will be told in advance and the new price will only apply after your current period ends.
Refunds and cancellation
Purchases are made through the App Store, so refunds are handled by Apple under its own policies: we cannot issue them ourselves. Deleting your account does not cancel an active subscription: you must cancel it separately in your Apple account settings, otherwise billing continues.
If you are a consumer in the EU or the UK, your statutory right to withdraw from a distance purchase within 14 days is unaffected, subject to the exceptions that apply to digital content you have started using.
Apple and the App Store
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is not a party to any dispute between us. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You must also comply with the App Store's own terms of use when installing and using Brimful.
Changes to the app
We keep working on Brimful, so features can change, be added, or be removed. If we ever have to remove something significant that you paid for, we will tell you in advance and, where appropriate, offer you a remedy.
Availability
We do our best to keep Brimful available and accurate, but we cannot promise it will be free of errors or interruptions. Maintenance, third-party outages and app store policies can all affect the service.
Feedback
If you send us ideas or suggestions, we may use them to improve Brimful without any obligation or payment to you. You keep the right to use your own ideas as you wish.
Disclaimer of warranties
To the extent the law allows, Brimful is provided "as is" and "as available", without warranties of any kind. Nothing here excludes warranties that cannot be excluded under the law that protects you as a consumer.
Limitation of liability
To the extent the law allows, we are not liable for decisions you take based on the figures the app shows, including any blood alcohol estimate, nor for indirect or consequential losses.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law. If you are a consumer, your statutory rights are unaffected.
Suspension and termination
You can stop using Brimful at any time and delete your account from the settings. We may suspend or close an account that breaches these terms, or that we are legally required to close; where it is reasonable to do so we will warn you first and give you a chance to fix the problem.
Changes to these terms
We may update these terms from time to time. Substantial changes will be announced inside the app before they take effect. If you keep using Brimful afterwards, you accept the new terms; if you do not agree with them, you can delete your account.
Governing law and your rights as a consumer
These terms are governed by Italian law, where the developer is based. This does not deprive you of the protection of the mandatory consumer rules of the country where you live: those rules prevail wherever they give you stronger rights, and you can always bring proceedings before the courts of your place of residence.
If part of these terms fails
If any provision is found invalid or unenforceable, the rest stays in force and the invalid part is replaced by the closest valid equivalent. These terms, together with the Privacy policy, are the whole agreement between us about Brimful.
